Introduction and Acceptance of Terms

Welcome to Wisku AI, an AI creative studio built around multiple AI models for creating images, remixing references, editing with prompts, and turning stills into videos. Our platform lets you start with text, reference images, or both, choose an available model, compare results, and continue editing or animating the result you select. It is designed for artists, designers, content creators, and anyone exploring visual ideas. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Wisku AI (the "Service", "we", "us", or "our") is owned and operated by SpeciAI LLC. These Terms of Service constitute a legally binding agreement between you and SpeciAI LLC. Full company details are provided in the Company Information section at the end of these Terms.

Use of the Service

Wisku AI provides tools for image generation, reference-based image editing, text-to-video generation, and image-to-video generation. Available inputs, settings, formats, and credit costs depend on the selected model and are shown in the product. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations. You also agree not to use our service for any harmful, discriminatory, or malicious purposes, including generating content that violates intellectual property rights or creating content for illegal activities.

User Accounts and Registration

Account Creation: To access our premium image and video generation features and editing tools, you need to create an account. You must provide accurate and complete information during the registration process. Free accounts include credits for trying image generation, as described in the current pricing details.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

All content and creative tools provided through Wisku AI, including but not limited to our AI algorithms, image and video generation features, reference editing options, and processing guides, are protected under copyright law. The copyright owner of Wisku AI is wisku.ai.

You acknowledge that you do not own the underlying AI algorithms, image and video generation tools, or intellectual property that makes up the Wisku AI service, and you agree to respect our intellectual property rights and those of any third parties.
While you retain ownership of any remixed images or generated materials you create using our tools, the core Wisku AI platform, algorithms, and methodologies remain our property.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Wisku AI:

Redistributing or reselling our image and video creation tools without authorization
Creating derivative works based on our proprietary algorithms for commercial purposes
Unauthorized access to or manipulation of our platform systems
Using the service for any illegal or unauthorized purpose
Attempting to bypass any security features or subscription limitations
Reverse engineering our AI algorithms for competitive purposes
Sharing premium features with non-subscribers
Using generated content to misrepresent capabilities or create deceptive images or videos

Prohibited Content and Acceptable Use Policy

Wisku AI is intended for lawful, respectful, and creative use only. You are solely responsible for the prompts and reference media you provide and the content you generate. You strictly agree not to upload, create, generate, distribute, or store any content that falls into the following categories:

1. Obscene, Pornographic, and Sexual Content

Obscene, pornographic, or sexually explicit material of any kind
Adult or "not safe for work" (NSFW) sexual content
Nudity or sexualized depictions produced without a legitimate, lawful purpose

2. Child Sexual Abuse Material (CSAM) and Content Involving Minors

Any child sexual abuse material (CSAM), or any sexualized, exploitative, or abusive content involving minors
Any content that depicts, sexualizes, or endangers anyone under the age of 18, whether real or AI-generated
We enforce a zero-tolerance policy for CSAM. Such content will be removed, the account permanently terminated, and reported to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement authorities.

3. Non-Consensual and Deceptive Depictions of Real People

Non-consensual intimate imagery (NCII), including "deepfake" nudity or sexual content depicting real, identifiable individuals without their consent
Realistic deepfakes or synthetic media that impersonate real individuals in a deceptive, harmful, defamatory, or misleading manner
Impersonation of celebrities, public figures, or any real person without authorization, including for endorsement, fraud, or reputational harm
Any use of a person's likeness in violation of their rights of publicity, privacy, or applicable law

4. Political Deception and Misinformation

Politically sensitive content intended to manipulate elections, deceive voters, or spread disinformation
Fabricated or manipulated media presented as authentic in order to mislead the public regarding political matters, public officials, or current events

5. Hateful, Discriminatory, and Violent Content

Content that promotes hatred, harassment, or discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
Racially discriminatory, demeaning, or dehumanizing content
Graphic, gory, or bloody violence, or content that glorifies, incites, or threatens violence or self-harm
Insulting, defamatory, harassing, or abusive content directed at any individual or group

6. Other Illegal and Harmful Content

Content that is otherwise illegal under applicable local, state, national, or international law
Content that infringes on third-party intellectual property rights
Content that promotes terrorism, extremism, illegal weapons, illegal drugs, or other unlawful activities
Malware, phishing, or content designed to defraud, deceive, or harm others

Enforcement

We employ a combination of automated filtering, human review, and user reporting to detect and control prohibited content. We reserve the right, at our sole discretion and without prior notice, to:

Remove or block any content that violates this policy
Suspend or permanently terminate accounts involved in violations
Preserve records of violations and report unlawful content to the appropriate authorities as required by law

Reporting Violations

If you encounter content generated, shared, or stored through Wisku AI that you believe violates this Acceptable Use Policy, please report it by emailing our monitored support channel at [email protected]. Use the subject line “AUP Violation Report” and, where available, include:

A link, generation identifier, screenshot, or other information that helps us locate the content
A brief description of the suspected violation and the relevant policy category
Any supporting context or evidence that may help us evaluate the report

Please do not download, attach, or redistribute illegal content solely for reporting purposes. For suspected child sexual abuse material or other illegal content, provide only the location and information necessary for us to identify it.

How We Handle Reports

After receiving a report, we will:

Acknowledge receipt and triage the report based on the nature and severity of the alleged violation.
Conduct an objective review, which may include automated checks and human review, and request additional information when necessary.
Take appropriate action when a violation is confirmed, which may include blocking or removing content, restricting features, suspending or terminating accounts, preserving relevant records, and notifying law enforcement or other authorities where required by law.
Notify the reporter of the outcome when appropriate and legally permitted. Some details may be withheld to protect privacy, security, confidential information, or the integrity of an investigation.

We handle reports in good faith and keep the reporter's identity confidential to the extent reasonably possible and permitted by law. Knowingly false, malicious, or abusive reports may result in appropriate action.

By using Wisku AI, you agree to use the Service only for lawful purposes and in compliance with this Acceptable Use Policy.

Privacy and Data Collection

Wisku AI collects the following types of data:

Account Information: Information you provide when creating an account
Image and Video Creation Data: Your prompts, uploaded reference media, model selections, generation settings, and generated results
Usage Details: Data related to your image and video generation history and feature access
Device Information: Information about the device you use to access our service
Cookies: Data that helps us enhance your creative workflow
Payment and Billing Information: Data necessary to process payments for subscriptions

Pricing and Payments

All subscription payments are processed monthly or annually based on your selected plan
Prices are subject to change with notice to users; any price change will apply only to billing cycles after the change takes effect
You agree to pay all charges, applicable taxes, and fees associated with your subscription
Payments are processed by our third-party payment providers (such as Stripe); by subscribing, you also agree to the applicable payment provider's terms

Subscription and Cancellation

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date
You can cancel your subscription at any time through your account settings or by contacting [email protected]
When you cancel, your subscription remains active until the end of the current billing period, and you will retain access to paid features and any remaining credits for that period
After the current billing period ends, your subscription will not renew and you will not be charged again
Cancellation does not automatically trigger a refund; refund eligibility is governed by the Refund Policy below
Enterprise customers may have custom subscription and billing terms as specified in their individual agreements

Refund Policy

We want you to be satisfied with Wisku AI. This Refund Policy applies to all paid subscriptions and credit purchases made through the Service. A standalone version of this policy is also available at Refund Policy.

Eligibility

Refund window: You may request a refund within 7 days of your initial purchase or renewal charge.
Usage condition: Refunds are available only if you have used less than 50% of the credits included in the corresponding billing cycle at the time of your request.
Requests made after the 7-day window, or after using 50% or more of your credits, are generally not eligible for a refund.

Non-Refundable Situations

Credits or subscription periods that have already been substantially used (50% or more)
Charges older than 7 days at the time of the request
Accounts terminated or suspended for violation of these Terms, including the Acceptable Use Policy
Fees explicitly identified as non-refundable at the time of purchase

How to Request a Refund

To request a refund, contact us at [email protected] with your account email and the transaction details. We will review your request and respond within a reasonable time.

Processing

Approved refunds are issued to the original payment method through our payment provider.
Depending on your payment provider and bank, it may take several business days for the refunded amount to appear in your account.
Upon a refund, any remaining credits associated with the refunded purchase will be revoked, and related premium access may be discontinued.

Statutory Rights

Nothing in this Refund Policy limits any non-waivable rights you may have under applicable consumer protection laws. Enterprise customers may be subject to the specific refund terms set out in their agreements.

AI Processing, Image Generation, and Video Creation

When using Wisku AI's image and video creation features:

Media Processing: We may process your prompts, uploaded reference images, and other reference media supported by the selected model to generate or edit images and create videos
Performance Optimization: Your usage patterns are analyzed to enhance the speed and quality of AI image and video generation operations and processing capabilities
Generated Content: Remixed images and generated materials created through our platform belong to you, but the underlying AI algorithms and processing methods remain our property
AI Training: Aggregated and anonymized usage patterns help us improve Wisku AI and its image and video generation capabilities
Content Quality: While we strive to provide high-quality AI-generated images and videos, you are responsible for reviewing and ensuring the appropriateness of generated content before use

Content Usage and Responsibility

You acknowledge and agree that:

Generated images and videos should be used responsibly and ethically
You are solely responsible for how you use AI-generated images and videos
Wisku AI is a tool for creative image and video generation, not for creating harmful or deceptive content
You should comply with all applicable platform policies where you intend to use generated images and videos
You will not use our service to create content that violates laws, regulations, or third-party rights

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. While we strive to provide high-quality image and video creation tools and maintain platform availability, we make no warranties about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Wisku AI shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless Wisku AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, and applicable United States federal law, without regard to its conflict of law provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Wyoming, and you consent to the personal jurisdiction of such courts. Where permitted by applicable law, disputes may alternatively be resolved through binding arbitration conducted in accordance with applicable United States law.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
